Enter to win the Mercy Kids Facebook Contest, which runs April 17-30, 2014. Here are the rules and regulations.
Terms and Conditions
NO PURCHASE NECESSARY TO ENTER OR WIN. Contest begins on 12:01:00 a.m. Central Daylight Time on April 17, 2014 and ends at 11:59:59 p.m. Central Daylight Time on April 30, 2014. Internet access and entry of limited personal information on Mercy’s page are required for entry. Void where prohibited by law. Odds of winning depend on the number of eligible entries received during the contest.
Who may enter
This contest is open to legal residents of Oklahoma, Missouri, Arkansas and Kansas who are 18 years old or older. By submitting an entry, each contestant agrees to the rules of the contest and further agrees that Mercy may rely on the contestant’s representation that he or she is 18 years old or older, is a legal resident of one of the four states listed above, and is the parent or legal guardian of the child or dependent in the photo, having the full legal right and authority to submit the photo of the child or dependent in this contest and to grant Mercy the right to use the photo and the subject’s likeness as described below. Mercy employees and their immediate families are eligible and encouraged to enter. Contestants may submit multiple entries, but an individual may win only one time; submissions from prior winners are ineligible and will be disregarded.
What to enter
A photo of your child or dependent doing “what he/she loves.” We do not accept digitally or otherwise enhanced or altered photos. Minor adjustments, including spotting, dodging and burning, sharpening, contrast and slight color adjustment or the digital equivalents, are acceptable. If our judges determine that a photographer has altered his or her photo, they reserve the right to move the photo to disqualify it. Photos that violate or infringe upon another person’s rights, including but not limited to copyright and rights of publicity or privacy, are not eligible.
All entries must comply with Facebook’s Terms and Policies. In addition, entries that do not conform to the spirit of the contest will be disqualified. This includes, but is not limited to, photos that portray: any bodily harm to any human or animal; any damage to property, private or public; trespassing; anything of a sexual nature, directly or by innuendo; or anything unlawful, false, misleading, threatening, abusive, tortious, obscene, hateful, racially or ethnically offensive, or otherwise objectionable in the sole judgment of the managers of the Mercy Kids Facebook Page.
How to enter
The contestant must “Like” the Mercy Kids Facebook Page (http://facebook.com/MercyKidsPage) and upload a photo of his or her child or dependent to the page’s wall. We do not accept photographs submitted through the mail, on message boards and comment threads, or by means other than through the public wall. High-quality scans of non-digital photographs are acceptable. Digital photographs should be taken at the highest resolution possible. Photographs must be in a .jpeg, .jpg or .gif format. Mercy may display the four winning childrens’ photos publicly on its main Facebook fan page (http://facebook.com/MercyHealth). Mercy reserves the right to disqualify contestants. By entering the contest, entrants grant Mercy a royalty-free, worldwide, perpetual, non-exclusive license to distribute, reproduce, and create marketing materials with the submitted photos, including the likeness of the photo’s subject, in whole or in part, for advertising and/or publicity purposes in all media now known or hereafter discovered, worldwide and on the Internet, without notice, review, approval, additional compensation or time limitation. Marketing representatives may also contact entrants to discuss further photography opportunities.
Photos from contestants must be uploaded to the page’s wall between 12:01:00 a.m. Central Daylight Time on April 17, 2014 and 11:59:59 p.m. Central Daylight Time on April 30, 2014.
An independent service will be utilized to randomly select four winning photos on May 1, 2014. Each contestant who uploads a winning photo will be notified on Friday, May 1, and will be required to provide further contact information. A grand prize of four tickets to a game played by a St. Louis professional sports team, with the team and game to be selected by Mercy, will be provided to each of the four winners. Transportation and lodging will not be provided. For each winning photo, the subject’s parent or guardian must fill out and sign an affidavit of eligibility and release form (available at http://bit.ly/MercyRelease) and provide it to Mercy upon request.
Release, Indemnity and Hold Harmless
By submitting an entry, each contestant completely releases, and agrees to indemnify and hold harmless, each of Mercy and Facebook, and their respective affiliates, directors, officers, employees and agents (“Released Parties”), from any and all liability whatsoever, and waives any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the contest or the delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. None of the Released Parties shall be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged entries; (b) any contest disruptions, injuries, losses or damages caused by events beyond their control; or (c) any errors in any materials associated with the contest.
Prizes cannot be transferred, substituted or redeemed for cash. Mercy reserves the right to substitute a prize, or portions thereof, with a prize of equal or greater value.
This contest is governed by U.S. law and is subject to all federal, state and local laws. The managers of the Mercy Kids Facebook Page have final word on winner selection and prize distribution.
